Author of the terms of service

The TMI PalkkaOnline service is provided by PalkkaOnline Oy (Business ID 3020384-5), whose official address is Microkatu 1, 70210 Kuopio.

Terms

  1. The service provider is PalkkaOnline, which provides the service through PalkkaOnline Oy. The service provider is also referred to as "PalkkaOnline", "TMI PalkkaOnline" and "TMI PalkkaOnline service" in the terms and conditions.
  2. The service user is the person who performs the work.
  3. The principal is the person who orders the work.
  4. By invoicing assignment is meant the billing of the work done by the service user to the principal through TMI PalkkaOnline.
  5. The formal employer is PalkkaOnline's operation, where PalkkaOnline forwards the compensation paid by the principal to the service user.

Purpose

The purpose of the terms and conditions of use of the TMI PalkkaOnline service is to define the conditions and terms for the payment of the compensation for the work performed between the service user and the principal through the TMI PalkkaOnline payment service.

The user's obligations

  1. The use of the TMI PalkkaOnline service requires the service user to create an account on the TMI PalkkaOnline website at tmi.palkkaonline.fi.
  2. The service user must accept the terms of use of TMI PalkkaOnline before sending an invoicing assignment. The service user must inform the principal that the invoice for the work done will be paid through TMI PalkkaOnline.
  3. The service user agrees on the work performance and the compensation and fee to be paid with the principal. The service user is liable to pay taxes in Finland for the work invoiced through TMI PalkkaOnline.
  4. The service user is responsible for complying with the legislation of Finland.
  5. The service user is responsible for the accuracy of the information provided to both the service provider and the principal.
  6. The service user is responsible for the accuracy of the expense invoices. The service user cannot invoice the costs between their home and their actual workplace unless the trip is considered exceptionally part of the work performance. This must be agreed with the principal.
  7. The service user is responsible for providing proof that they have delivered the work according to the invoicing assignment agreement between the service user and the principal. The service user is responsible for ensuring that the work done is not illegal.
  8. The service user is responsible for determining whether they are required to take out an entrepreneur's pension insurance (YEL). The user is responsible for ensuring that the information concerning their insurance has been correctly reported to PalkkaOnline and the insurance company. The user is responsible for informing PalkkaOnline of the start and end dates of the insurance. The user is responsible for any retroactive health insurance premiums related to the YEL insurance.
  9. The service user is responsible for informing PalkkaOnline of any income subject to YEL insurance that the user may receive through another channel.
  10. The service user is responsible for determining whether the invoicing assignment is subject to the Farmers' Pension Act (MYEL). The service user cannot invoice work through TMI PalkkaOnline that is subject to the Farmers' Pension Act.
  11. The service user is not allowed to make purchases on invoice, credit, installment, or subcontracting agreements in the name of PalkkaOnline.
  12. The service user is responsible for accepting the current privacy policy of TMI PalkkaOnline and the related register descriptions.
  13. The service user is responsible for their own customer register as the data controller, as well as for the accuracy and legality of the register data. In addition, the user is responsible for ensuring that the user has the right to process the data, deliver it to TMI PalkkaOnline for processing, and grant TMI PalkkaOnline the right to process it.
  14. The service user is responsible for any damage caused to PalkkaOnline as a result of the user's error or negligence, which has resulted in PalkkaOnline having to pay damages to a third party.
  15. The service user is not entitled to transfer the rights and obligations under these terms and conditions to third parties.

The principal's obligations

The principal is responsible for ensuring that the service user meets the statutory requirements for the work performance or tasks. These requirements may include various permits, qualifications, and special insurance required for the work performance.

PalkkaOnline's obligations

  1. PalkkaOnline provides the user with accident and liability insurance through the insurance company Fennia. The liability insurance compensates the principal or third parties for personal and property damage that occurs during work up to 1,000,000 euros according to the insurance terms and conditions. According to the terms and conditions, the service user is responsible for paying the VAT on the damage that the insurance company may charge, as well as the deductible.
  2. PalkkaOnline is responsible for the normal employer obligations in taxation as a formal employer, which include withholding tax from the salary, paying the employer's health insurance contribution, and reporting the payments to the income register.

Other terms

  1. You cannot invoice temporary agency work through TMI PalkkaOnline. PalkkaOnline is not a temporary agency employer.
  2. There is no employment relationship between TMI PalkkaOnline and the service user that accords to the Tax Collection Act 14§, and Employment Contracts Act 1:1 §. PalkkaOnline acts only as a formal employer.
  3. PalkkaOnline has the right to reject an invoice that violates the terms of use.
  4. The service user is not insured by PalkkaOnline for occupational accident insurance or group life insurance, as the service user is not in an employment relationship with PalkkaOnline.
  5. TMI PalkkaOnline service only collects the health insurance contribution according to the current legislation from those users who are obligated to take out YEL insurance or who have taken out voluntary YEL insurance.

Fees, costs and compensation

  1. The service fee and additional fees are charged at the time of payment.
  2. The amount to be paid to the user is determined based on the value of the invoiced amount excluding VAT. Withheld tax is deducted from the invoiced amount excluding VAT, as well as the employer's health insurance contribution in applicable cases, and the PalkkaOnline service fee, as well as other charges that are shown in the calculation. The calculation is downloaded from the user's own control panel.
  3. PalkkaOnline has the right to reject the expense invoices submitted. The reimbursement of tax-free travel expenses requires that they have been invoiced to the principal in such a way that they are itemized on the invoice.
  4. When the payment is received in the TMI PalkkaOnline service account, the user can withdraw the salary and the payment is transferred to the user as soon as possible, unless otherwise agreed with the user. The condition for the payment is that the user has provided all the information needed to make the payment.
  5. The user receives a payment statement in connection with the payment. The payment statement is in electronic form in the user's own control panel.

Purpose and legal basis of the processing of personal data

Personal data is processed for the following purposes:

  • Providing the service, managing customer relationships, administration and customer communication.
  • Maintaining user information.
  • Performing assignments authorized by users, such as sending invoices and receiving payment from the customer, paying salaries, handling insurance matters and collection.
  • Surveys, such as customer satisfaction surveys.
  • Compliance with legal obligations and instructions from authorities and official guidelines, such as handling tax matters.
  • Business and service development, statistics, analysis and data security.
  • Risk management.
  • Investigating misuse.
  • Marketing.
  • Users are profiled and decisions based on personal data can be made through automated processing, such as targeted offering of additional services.
  • The processing of personal data is based on a contract, consent, legal obligation or PalkkaOnline's legitimate interest. Legitimate interests include data transfers within the group, data processed to implement data security, investigate misuse and direct marketing.

Personal data processed

The processed personal data may include:

  • Name.
  • Contact information (phone number and email address).
  • Age.
  • Sex.
  • Occupation.
  • Personal identity code.
  • Citizenship and information on work permit if necessary.
  • Tax information.
  • Possible enforcement data.
  • Information related to salary payment.
  • Information related to the customer, such as information on assignments authorized by the customer.
  • Necessary identifier and technical usage data related to transactions, such as customer service call records, cookies and log data, location data related to kilometer allowances.
  • Copy of the identity document if necessary.
  • Documents and certificates required to verify professional qualifications.
  • Criminal background check for determining the criminal background of those working with children. Only the presentation of the extract and its identification information are recorded in the data subject's information. The extract is not permanently stored.
  • Customer reviews of the service provided with the user's consent.

Regular sources of information

We collect personal data primarily from the data subject themselves in connection with registration and use of the service. Information may also be collected from the customer. Personal data is also collected and updated from authorities providing services related to personal data.

Disclosure of information

Personal data may be disclosed to service providers who process personal data on behalf of PalkkaOnline in accordance with confidentiality obligations and contractual data protection obligations.

Personal data may also be disclosed within the group of companies for the purposes described in the description, as well as for the marketing of the products and services of these companies and for administrative purposes, such as processing data in a centralized information system.

Storage period of personal data

Personal data is stored as long as the processing is necessary for the purposes of the collected personal data for a maximum of 10 years from the person's last use event, unless the data subject has withdrawn any consent given. Personal data may be stored for a longer period if this is necessary to comply with legislation or other authority source such as e.g. the Accounting Act obligation.

Protection of the register

The register is stored in a secure system that can only be accessed by the data controller and technical administrators authorized by the data controller.

Rights of the data subject

The data subject has the right to request the data controller to access the personal data concerning him or her, the right to request the correction of his or her personal data, the right to request the restriction of the processing of personal data or the deletion of personal data, and the right to object to the processing of personal data. The data subject also has the right to receive the personal data concerning him or her that he or she has provided in a commonly used, machine-readable format and the right to transfer this data to another data controller. If technically possible, the data subject has the right to have the personal data transferred directly from the data controller to another data controller.

Right to lodge a complaint with the supervisory authority

The data subject has the right to lodge a complaint with the competent supervisory authority if PalkkaOnline Oy has not complied with the applicable data protection legislation in its operations.
